General Terms and Conditions

§ 1) Validity

These General Terms and Conditions (GTC) govern the relationship between customers (hereinafter referred to as the Customer) and Liechtensteinische Post AG (hereinafter referred to as Post) in relation to the sale of and subscription to stamps and articles as well as special philatelic products (hereinafter referred to collectively as Products). Philately Liechtenstein (hereinafter referred to as Philately) is a trademark of Liechtensteinische Post AG.

§ 2) Offers

The new product offers are published in writing in their print media and in the online shop (www.philatelie.li). The publication normally appears around six (6) weeks before the first day of issue of the respective products; in exceptional cases, it may also be published later.

The print runs of stamps and postal stationery will be published regularly in the respective novelty mailings and in the web shop, but no later than the following year.

The products will be offered and distributed if stocks last, but at the latest until the end of the respective sales period. The delivery of consignments on approval is not possible.

Unless otherwise stated, the prices quoted by Post (including VAT for VAT for products subject to VAT but excluding any customs duties for customers not resident in Liechtenstein and Switzerland). For foreign customers, the local EU import VAT applies and therefore the rates of the country of destination. Up to a purchase value of EUR 150, the EU import sales tax will be charged directly to the customer during the purchase in the online shop and transmitted to the relevant countries.

From a purchase value of EUR 150.01, the EU import VAT will be charged to the recipient upon receipt of the consignment on site. Post has no influence on any additional fees incurred by third party providers. The products remain the property of Post until full payment has been received.

§ 3) Special requests

Special requests such as products with special imprints or labelling as well as misprints and products with other anomalies cannot be considered.

If available, regular products of the same order quantity will be delivered instead. Only orders for corner margin pieces and single stamps with full cancellations, crescent cancellations, etc. will be considered where possible, without, however, any entitlement to them.

§ 3) Delivery periods

Products which are in our warehouse are processed immediately after receipt of the order by us, other products are ordered from suppliers. The ordered products are delivered according to agreement with the customer. Delays due to unavailability of suppliers or missing information from the customer do not result in any claims by the customer.

§ 3) dieMarke.li

4.1. Subject of the Service
The Post offers customers the opportunity to design their own personalised and individual stamp. It consists of the forgery-proof frame pre-print including punched perforation with a fixed frame - available in a choice of colours - the lettering ‘Liechtenstein Post’ and the indication of a selectable nominal value as well as the printable blank field. An image digitally transmitted by the customer is displayed on the printable blank field. It is not possible for the Post to rework the transmitted image.

Personalised stamps cannot be exchanged for other stamp values.

The Post will deliver to the customer within one week of the order being placed (excluding public holidays). The minimum order quantity is 1 piece for the 20-piece sheets, 1 set of 6 pieces for the 3-piece blocks and 1 set of 8 pieces for the picture postcard. 

Orders placed by Wednesday, 10 a.m. (excluding public holidays) will be considered. Express deliveries are possible for a surcharge of CHF 35. Please contact our customer service for this.

The Post reserves the right to exclude picture motifs from the production of a personalised stamp without giving reasons. Image motifs that are immoral and/or violate applicable law are generally excluded. In the event of rejection, the customer will be informed by e-mail. In any case, the image will not be returned to the customer.

4.2. Obligations of the customer
By placing an order, the customer confirms that

  • all rights to the transmitted image (in particular copyrights, trade mark rights, etc.) are held by the customer;
  • all rights to the transmitted image (in particular copyrights, trade mark rights, etc.) are held by the customer;
  • if the image motif is a work within the meaning of copyright law, he is authorised to edit, reproduce and distribute it.

The Customer shall grant the Post the right to process and reproduce the image free of charge for the purpose of producing the personalised stamps ordered.

Furthermore, the Post reserves the right to publish the image of the personalised stamps produced to advertise this service offer in its own online shop, but also on social media platforms.

The Post is not obliged to check the transmitted image for accuracy, completeness or compliance with the statutory provisions.

§ 5) Sale of products

Products are sold in the online shop via the Post branches or their respective sales partners while stocks last and without the possibility of ordering or reserving products in advance.

§ 6) Ordering products

6.1. Placing orders for orders 
Orders must be placed in the online shop. Or in writing, by telephone or by e-mail [briefmarken@post.li]. In the event of unclear information and designations, we reserve the right to enquire with the customer. For orders of less than CHF 30.00, a processing fee of CHF 9.00 will be charged.
 
Subscribers receive our current new issues on time, postage free and without handling charges delivered directly to their home. Customers with a subscription will not be charged any handling fees for additional orders, even if the minimum order quantity is not reached.

6.2. Curtailment of orders
Orders shall be processed in the order in which they are received by the Post. In individual cases, particularly in the case of limited editions, the Post reserves the right to reduce orders in whole or in part.

6.3. Delivery
Unless otherwise agreed, orders shall be sent as regular A Mail items to the last address provided by the customer. The customer is free to choose whether to send the goods by registered post. Additional costs will be charged to the customer. Express orders are not possible. In the absence of instructions to the contrary, deliveries to previous customers shall be carried out in the same way as previous orders.

If the customer denies receipt of one or more consignments, further consignments will be sent to the customer by registered post with the corresponding postage charge.

6.4. Securities
The Post may request advance payments or payments on account at any time, in particular for orders with high order values, for new customers or in cases where a corresponding procedure appears necessary for another reason.

6.5. Expiry of orders
If a customer's account shows outstanding balances within 45 days of receipt of an order, the Post reserves the right to cancel the order.

§ 7) Payment of the ordered products

7.1. Payment methods
Payment by credit card is only possible for purchases in the webshop. Invoices from the Post are paid by bank transfer.

Customers in Liechtenstein and Switzerland can also authorise the Post to debit the customer's postal account (PostFinance) directly. The postal account will be debited at the end of each billing month. On the other hand, stamps and other tangible assets are not accepted as means of payment.

7.2. Invoice amount and payment deadline
The invoice amount of the respective order can be found on the invoice. Invoices are payable within 30 days of the value date. In principle, the Post reserves the right to require payment in advance.

7.3. Payment principles
The customer's payment receipts must always be labelled with the name, address and customer number.

§ 8) Subscription products

8.1. New subscriptions
Subscriptions can be taken out at any time with effect from the next issue date. The retroactive entry into force of subscriptions is excluded. Any products from previous issues that are still available can be ordered.

8.2. Amendment and cancellation of subscriptions
Subscriptions may be amended up to 9 weeks before the issue date. However, the Post reserves the right to restrict short-term or above-average subscription cancellations or increases.

The subscription can be cancelled quarterly until the following dates in writing by post or e-mail (postmark, e-mail receipt date): 31 March / 30 June / 31 August / 31 December.

The yearly subscription can be cancelleded until 31 October. 

If the subscription is cancelled in due time, there will be no delivery for the next subscription run. Cancellation will be confirmed to the customer in writing. 

8.3. Delivery to subscribers
Subscription consignments cannot be delivered together with current orders. The principles set out in sections 5 and 6 apply mutatis mutandis to the expiry, delivery and payment of subscriptions.

§ 9) Complaints and exchange of products

9.1. Complaints
Complaints about products must be made in writing - within 30 days of receipt of the consignment - enclosing the products complained about and a copy of the invoice receipt.
Complaints due to non-delivery or incomplete delivery of products must be notified to the Post within 30 days of the invoice date of the respective product.

9.2. Exchange
Rejected products will be exchanged by the Post if a replacement is available in the required quantity. The Post may reject exchange requests if there are no recognisable quality defects.

Claims against the Post that go beyond the exchange of products, or the cancellation of individual orders are excluded.

The two gold and four silver coins from the ‘100 years of the Swiss franc in the Principality of Liechtenstein’ issue and the combined product consisting of a stamp block and small gold coin are excluded from redemption by Liechtensteinische Post AG. 

The two gold and four silver coins will be sent by FedEx if the buyer is not resident in the Principality of Liechtenstein or Switzerland. 

Further exchanges are not possible.

9.3. Suspicion of misuse
The Post reserves the right to refuse the exchange of all stamps in a request if misuse is suspected.

§ 10) Liability

The Post accepts no liability for late product deliveries or for incorrect product descriptions and illustrations or price details.

§ 11) Further provisions

11.1. Amendment of the General Terms and Conditions
The Post may amend the General Terms and Conditions and the range of services at any time. The respective new version will be published on the Post website at www.post.li and the philately website at www.philatelie.li in good time before it comes into force and will be communicated in writing. In the absence of a cancellation within 30 days of the date of dispatch of the notification, these shall be deemed to have been accepted.

11.2. Data protection
The data required for business transactions will be processed by the Post and stored to the extent necessary. The Post complies with the provisions of the Post Act and the Liechtenstein Data Protection Act when collecting and processing personal data. It takes appropriate measures to protect customer data and treats it confidentially.

Data may be passed on to third parties for the provision of services. These third parties may also be domiciled abroad.

With the prior consent of the customer, certain personal data, in particular address data, may be disclosed to other third parties in individual cases within the scope of the previously communicated processing purposes. 

The legal obligation to exchange address data with other postal service providers in the context of forwarding, retention and redirection orders as well as disclosure in other cases provided for by law remains reserved.

11.3. Rights of data subjects
The customer may request information about the processing of their personal data. The customer has the right to have their data deleted or destroyed. Insofar as the data is not required for the fulfilment of services requested by the customer, the customer may prohibit or block the processing of their data - in particular also its disclosure to third parties. The customer has the right to have incorrect personal data corrected. 

If neither the accuracy nor the inaccuracy of the data can be established, the customer may request that a note of dispute be added. If the customer has given their express consent to further data processing, they can revoke this at any time. This does not affect the lawfulness of data processing for the duration of the valid consent. Legal requirements that oblige or authorise the Post to process or disclose data remain reserved. 

If the deletion of the data is not permitted for legal reasons, the data will be blocked instead of deleted.
To assert the rights of the data subject, the customer should write to the following address with a copy of the passport or ID: Liechtensteinische Post AG, Alte Zollstrasse 11, 9494 Schaan, or by e-mail to datenschutz@post.li. 11.4. Involvement of third parties
The Post may engage third parties to provide services and make the necessary data available to the engaged third parties. The processor is subject to the same data protection obligations as the Post itself and may not process the data for its own purposes and only on behalf of and on the instructions of the Post, unless otherwise provided by law. The Post is obliged to carefully select, instruct and monitor its service providers. The processors may also be domiciled abroad. The Post guarantees the adequacy of data protection at the processor in the destination country.

11.5 Severability clause
Should one or more provisions of these GTC be ineffective or invalid or contain a loophole, this shall not affect the validity of the remaining provisions of these GTC. The invalid or ineffective provisions shall be interpreted or replaced in such a way that they correspond as closely as possible to the intended purpose of these GTC. The same applies in the event of a contractual loophole.

11.6. Applicable law and place of jurisdiction
The Princely District Court, Vaduz, shall have exclusive jurisdiction for legal action against the Post. The Post has the right to sue the Customer at the Princely Court of Justice, Vaduz, or at any other competent court.

The legal relationship between the Customer and the Post shall be governed by the law of the Principality of Liechtenstein.

11.7 Legally valid form of publication
The GTC, which are solely legally binding and form an integral part of the contract, are published electronically and can be viewed on the Post website at www.post.li.Im. In individual cases, the Post may provide a physical version of the GTC at the Customer's request. The Customer acknowledges that a physical version of the GTC is only a representation of the electronically published GTC valid at that time, which alone are legally binding, and only provides legally valid information if it corresponds to the electronic version.

11.8 Validity
These GTC shall enter into force on 01.01.2025. They replace the previous provisions.
